These Terms of Intellectual Property Monitoring and Authorized Infrastructure Usage ("Terms") constitute a legally binding agreement between Crazytower ("Brand Owner," "we," "us," or "our") and any individual, entity, or automated system ("User," "you," or "your") that accesses, interacts with, or submits information to the Brand Protection & Copyright Integrity Node accessible at crazytower-protect.site ("Portal" or "Node"). By accessing the Portal, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you do not agree to these Terms, you must immediately cease all use of this Portal. Use of this Portal for any purpose constitutes unconditional acceptance of these Terms.
1. Definitions and Scope
1.1 Defined Terms
For the purposes of these Terms, the following definitions apply:
- "Brand Assets" means all trademarks, service marks, trade names, logos, domain names, copyrighted works, trade dress, and other intellectual property owned by or exclusively licensed to Crazytower, including all assets associated with the domain
crazytower.comand its authorized sub-properties. - "Protection Node" means the technical and operational infrastructure deployed at
crazytower-protect.sitefor the purpose of monitoring, enforcing, and managing Brand Assets. - "Monitoring Activities" means all automated and manual processes conducted by or on behalf of Crazytower to detect, document, and respond to unauthorized use of Brand Assets across digital and physical channels.
- "Authorized Infrastructure" means the servers, domains, email systems, DNS records, and related technical components that are explicitly sanctioned by Crazytower for use in connection with brand protection operations.
- "Complainant" means any person or entity that submits a copyright infringement notice, abuse report, or other formal complaint through this Portal.
- "Infringing Content" means any material that reproduces, distributes, publicly displays, or creates derivative works from Brand Assets without authorization.
1.2 Scope of Application
These Terms apply to all interactions with the Portal, including but not limited to: browsing or accessing any page of the Portal; submitting DMCA notices, counter-notices, or abuse reports; sending correspondence to any intake email address hosted on this domain; and any automated access, crawling, or programmatic interaction with Portal resources.
2. Portal Authorization and Ownership
2.1 Authorized Deployment
The Portal operating at crazytower-protect.site is an officially authorized
protection infrastructure node deployed by and on behalf of Crazytower.
The Portal is operated as a delegated protection gateway, with the primary brand presence
maintained at crazytower.com. All operational activities conducted through
this Portal are sanctioned under Crazytower's infrastructure governance policy.
2.2 Intellectual Property Ownership
All content, design elements, text, code, and materials published on this Portal are the exclusive property of Crazytower or its authorized licensors and are protected by applicable intellectual property laws. No content from this Portal may be reproduced, distributed, modified, or used for any commercial purpose without the prior written consent of Crazytower.
2.3 Domain Authorization
The domain crazytower-protect.site is registered and operated by Crazytower
as an authorized extension of its brand protection infrastructure. The domain is subject
to DNSSEC validation, DMARC enforcement, and all applicable security controls described
in the Technical Specifications published at technical-specs.html.
Any entity claiming authority over this domain without written authorization from Crazytower
is acting fraudulently.
3. Intellectual Property Monitoring Activities
3.1 Scope of Monitoring
Crazytower conducts continuous monitoring of digital environments for unauthorized use of Brand Assets. Monitoring activities may include, without limitation: automated scanning of publicly accessible web content; domain registration monitoring; social media surveillance; marketplace and e-commerce platform monitoring; and review of user-submitted abuse reports.
3.2 Data Collection During Monitoring
In the course of Monitoring Activities, Crazytower may collect and retain information about suspected infringing content, including URLs, screenshots, metadata, and associated account information, to the extent permitted by applicable law. Such data is retained solely for enforcement purposes and is handled in accordance with Section 7 of these Terms.
3.3 Enforcement Actions
Upon identifying Infringing Content or unauthorized use of Brand Assets, Crazytower reserves the right to take any or all of the following enforcement actions: issuance of cease-and-desist notices; submission of DMCA takedown requests to hosting providers, registrars, and platform operators; initiation of legal proceedings; referral to law enforcement authorities; and publication of enforcement actions to the extent permitted by law.
4. Authorized Infrastructure Usage
4.1 Permitted Uses
The Portal and its associated infrastructure are made available exclusively for the following authorized purposes: submission of legitimate DMCA copyright infringement notices; submission of counter-notifications pursuant to 17 U.S.C. § 512(g); reporting of abuse, unauthorized brand usage, or infrastructure anomalies; authorized verification of brand asset ownership; and technical correspondence with the Crazytower protection team.
4.2 Infrastructure Integrity
Users acknowledge that the Authorized Infrastructure, including all DNS records, email systems, and web-facing components of this Portal, is operated under strict security controls. Any attempt to interfere with, circumvent, or exploit the infrastructure of this Portal is strictly prohibited and may constitute a violation of the Computer Fraud and Abuse Act (18 U.S.C. § 1030), the Electronic Communications Privacy Act, and equivalent laws in other jurisdictions.
4.3 No License Granted
Access to this Portal does not constitute a grant of any license, right, or permission to use Crazytower's Brand Assets, trademarks, or any other intellectual property. Any use of Brand Assets requires a separate, written licensing agreement executed by an authorized representative of Crazytower.
5. DMCA and Copyright Enforcement Procedures
5.1 Compliance with 17 U.S.C. § 512
Crazytower operates this Portal in compliance with the Digital Millennium Copyright Act, 17 U.S.C. § 512. The Portal serves as a designated agent for receipt of copyright infringement notifications. All notices submitted through this Portal are processed in accordance with the statutory requirements of the DMCA.
5.2 Requirements for Valid Notices
To be actionable, a copyright infringement notice submitted to this Portal must satisfy all requirements set forth in 17 U.S.C. § 512(c)(3), including a physical or electronic signature, identification of the copyrighted work, identification of the infringing material, contact information, a good faith statement, and a statement of accuracy under penalty of perjury. Incomplete notices will not be processed and will be returned to the Complainant with a request for supplemental information.
5.3 Misrepresentation Liability
Pursuant to 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Crazytower will not hesitate to pursue all available legal remedies against Complainants who submit fraudulent or bad-faith notices.
5.4 Counter-Notification Procedure
Parties who believe their content was removed in error may submit a counter-notification pursuant to 17 U.S.C. § 512(g) to dmca@crazytower-protect.site. Counter-notifications must satisfy all statutory requirements. Upon receipt of a valid counter-notification, the original Complainant will be notified, and content may be restored within 10–14 business days unless the Complainant files a court action.
6. Prohibited Conduct and Misuse
6.1 Prohibited Activities
The following activities are strictly prohibited in connection with this Portal:
- Submitting false, fraudulent, or materially misleading DMCA notices or abuse reports;
- Impersonating Crazytower, its representatives, or any other person or entity;
- Attempting to gain unauthorized access to Portal systems, databases, or administrative interfaces;
- Conducting automated scraping, crawling, or data harvesting beyond what is necessary for legitimate search engine indexing;
- Transmitting malware, viruses, or other malicious code through any Portal intake channel;
- Using the Portal to harass, threaten, or intimidate any individual or entity;
- Circumventing or attempting to circumvent any security measure, authentication control, or access restriction implemented on the Portal;
- Using the Portal's brand, name, or visual identity to create a false impression of affiliation or endorsement.
6.2 Consequences of Misuse
Violations of this Section may result in immediate termination of access to the Portal, referral to law enforcement authorities, civil litigation, and/or public disclosure of the violation to the extent permitted by law. Crazytower reserves the right to seek injunctive relief, damages, and attorneys' fees in connection with any misuse of this Portal.
7. Data Handling and Confidentiality
7.1 Information Submitted to the Portal
Information submitted through Portal intake channels, including DMCA notices, abuse reports, and technical correspondence, is received and processed by Crazytower's protection team. Submitted information may be shared with legal counsel, law enforcement authorities, hosting providers, and platform operators to the extent necessary to investigate and enforce against alleged infringement.
7.2 Retention
All submissions and associated correspondence are retained for a minimum of 24 months from the date of receipt. Records may be retained for longer periods where required by law, ongoing litigation, or active enforcement proceedings.
7.3 Confidentiality of Enforcement Activities
Specific details of ongoing enforcement investigations, including the identity of subjects under investigation and the scope of monitoring activities, are treated as confidential and will not be disclosed to third parties except as required by law or court order.
8. Disclaimers and Limitation of Liability
8.1 Portal Availability
The Portal is provided on an "as is" and "as available" basis. Crazytower makes no warranty, express or implied, regarding the availability, accuracy, completeness, or fitness for a particular purpose of the Portal or its content. Crazytower reserves the right to modify, suspend, or discontinue the Portal at any time without notice.
8.2 Limitation of Liability
To the maximum extent permitted by applicable law, Crazytower shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of, or inability to use, this Portal, even if Crazytower has been advised of the possibility of such damages. Crazytower's total liability for any claim arising from these Terms shall not exceed one hundred United States dollars (USD $100.00).
8.3 Third-Party Actions
Crazytower is not responsible for the actions of third parties, including hosting providers, registrars, or platform operators, in response to DMCA notices or enforcement requests submitted through this Portal. Crazytower does not guarantee any particular outcome in response to submitted notices.
9. Indemnification
You agree to indemnify, defend, and hold harmless Crazytower and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Portal; (b) your submission of any notice, report, or correspondence through the Portal; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.
10. Governing Law and Dispute Resolution
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Crazytower is incorporated, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
10.2 Dispute Resolution
Any dispute arising from or related to these Terms or the use of this Portal shall first be submitted to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration or, where arbitration is not available or enforceable, through the courts of competent jurisdiction in Crazytower's registered jurisdiction.
10.3 Class Action Waiver
To the maximum extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration against Crazytower in connection with these Terms or the Portal.
11. Modifications to These Terms
Crazytower reserves the right to modify these Terms at any time. Modifications will be effective upon publication of the revised Terms on this Portal. The "Effective Date" at the top of this document will be updated to reflect the date of the most recent revision. Continued use of the Portal following the publication of modified Terms constitutes acceptance of those modifications. It is your responsibility to review these Terms periodically for changes.
